How to check the developer, licence, staged payments, specification and completion documentation when purchasing a new-build home in Marbella.
Before each transfer, obtain advice on the account, recipient and documentary protection applying to the payment. Keep the contract, transfer receipt and every individual or collective guarantee document.
The contract should identify the approved plans and quality specification and control the developer’s ability to alter dimensions, finishes, facilities or landscaping. Important sales promises should be written into binding documents.
Your advisers should review the completed legal and technical documentation, first-occupation position, utility status, insurance, community arrangements and Registry description. A snagging inspection addresses defects but does not replace legal due diligence.
Do not accept an extension or sign a waiver without advice. The contract, cause and seriousness of the delay affect the remedies available.
Do not assume so. Your lawyer should confirm the applicable arrangement and evidence for each payment.
Only within the legal and contractual framework. Material substitutions should be controlled by the contract.
That depends on their seriousness and the contractual position. Record defects and obtain legal and technical advice before completion.
Have the licence, developer, guarantees, specification and purchase contract reviewed before transferring reservation or staged funds.
