Buying in Marbella: The importance of the legal investigation before buying a property

Once you find the property you want to purchase in Marbella and both parties have agreed on a price, it’s recommended you hire a lawyer to help you with the entire transaction. First of all you’ll need to confirm the legality of the property, make sure no hidden fees or attachments are involved, and keep your money safe until the legal due diligence is completed with the followings steps:

When you hire the lawyer services, he will ask the seller of the property to hand over all the relevant paperwork and he will handle the legal searches to make sure everything is as it should be.

If the solicitor determines that everything is alright, he will request your authorization to sign the reservation contract or private purchase contract. Once you sign, you must pay 10% percent of the agreed buying price.

If you plan to buy a property in Marbella, you need to get the following requirements ready:

If you want to sell a property in Marbella, you can put it on the market and sell it on your own or you can hire one of the real estate agencies in Marbella to help you with the process. In this region, real estate agency fees average from 5 to 6 percent plus VAT (21%), depending on the services they provide.

The buyer’s lawyers will also require certain documents so they can do the appropriate legal searches to determine that the property is legal and there are no debts or charges linked to it.

If everything is in order, the next step is to sign a reservation contract or a private purchase contract, depending on the agreement that has been reached with the buyer.

After that, the buyer will have to make a partial payment of 3,000 to 10,000 euros of the price and a partial payment of 10 to 30 percent of the price, minus the reservation deposit.

The selling process will be completed when the title deeds are signed before a public notary and the balance of the selling price has been received.

If the seller is not a resident in Spain, the buyer will withhold 3% of the selling price, which is a provision to pay for capital gains tax. If there’s no profit made from the sale or if the 3% is more than the capital gains tax, the seller can claim a refund.
