Buying Rural Property in Ibiza

Why rural due diligence is different

Rustic land may be affected by agricultural, landscape, environmental and building restrictions. Older houses can include additions, pools or annexes that do not match approved plans or title records.

Essential rural-property checks

  • Registry title, cadastral parcels and surveyed boundaries.
  • Legal access and any road or rights-of-way arrangements.
  • Land classification and applicable protection.
  • Licences and authorised use for every building, pool and annex.
  • Open planning or restoration files.
  • Water source, well rights, cisterns and supply legality.
  • Electricity, wastewater and other service arrangements.
  • Minimum plot and segregation history.
  • Occupation, agricultural leases or third-party use.
  • Feasibility of intended renovation or expansion.

Boundaries and access

A buyer should not rely solely on fences or the seller’s description. A technical survey should be reconciled with Registry and cadastral information, while legal access should be documented rather than assumed from historic use.

Existing buildings and future works

Separate the question of whether a structure is registered, whether it was authorised and whether it may now be renovated, enlarged or rebuilt. Obtain a written technical-planning assessment for any project central to the purchase.

Contract conditions

Where access, water, licences or renovation feasibility are material, resolve them before the deposit becomes non-refundable or protect the buyer with clear conditions and remedies.

Does an old finca automatically become legal through age?

No. Age can affect enforcement questions, but it does not automatically prove authorisation or permit new works.

Can I renovate after purchase?
