Do You Need a Lawyer to Buy a Property in Mallorca?

Short answer: no, Spanish law does not oblige you to hire a lawyer to buy a property in Mallorca. But the notary who authorises the deed does not represent you, and many of the problems that affect buyers on the island, such as unlicensed extensions on rustic land, holiday-rental restrictions or debts attached to the property, are only found if someone checks on your behalf before you sign. That is the job of an independent property lawyer.

Lawyer vs notary: who does what?

International buyers often assume the notary protects them. The notary is a public official who confirms the identity and capacity of the parties, reads the deed, checks certain formalities and authorises the signing. The notary is impartial and does not negotiate for you, investigate planning issues or advise you on whether to buy.

What an independent lawyer does in a Mallorca purchase

  • Before you sign anything: reviews the reservation or arras contract and adds conditions that protect your deposit.
  • Title and charges: obtains the nota simple to confirm the owner, mortgages, liens and other charges.
  • Planning and licences: checks that the built area matches the records, that works were licensed and that there is a valid cédula de habitabilidad.
  • Debts: verifies IBI, community fees and utility payments are up to date.
  • Paperwork: helps obtain your NIE number, open a bank account and, if you cannot travel, sign under a power of attorney.
  • Completion: coordinates the signing before the notary, payment of the price and taxes, and registration of the deed.
  • After completion: transfers utilities and advises on your tax obligations and a Spanish will.

How much does a property lawyer cost in Mallorca?

Fees are commonly quoted as a percentage of the price, often around 1%, or as a fixed fee, plus 21% VAT. Ask for a written quote listing what is included. Compared with the price of a property and the cost of an undetected problem, it is a small part of the total purchase costs. See property lawyer costs in Spain.

Frequently asked questions

Is a lawyer compulsory to buy property in Spain?

No. It is not a legal requirement, but it is strongly advisable, especially for foreign buyers, because nobody else checks the property on your behalf.

Can I use the seller’s or the agent’s lawyer?

It is better not to. Your lawyer should act only for you, with no interest in the sale going ahead.

When should I hire a lawyer in Mallorca?

Before you sign a reservation or pay any deposit. That is when your lawyer can still negotiate protective conditions.
