Plusvalía Municipal: Questions Before a Property Sale

Plusvalía municipal concerns increases in the value of urban land on certain transfers. It is separate from the seller’s capital gains tax, so ask for its own calculation and filing instructions.

Check the property and the transaction

The national framework is in the Local Finance Law, while the municipality’s ordinance matters for the calculation and procedure. The law distinguishes urban land from rural land and contains non-taxable situations. Ask your adviser to assess the actual property classification and transaction.

Prepare evidence for the calculation

Provide acquisition and disposal documentation, dates, ownership shares and the cadastral information showing land value. Ask the adviser to review the legally available calculation methods and any evidence that there has been no taxable increase. Do not assume that a low sale profit automatically resolves the municipal position.

Agree responsibility before signing
